Rental House will be closed Monday May 25th for Memorial Day. Online reservations will be unavailable to start after Friday May 22th until Wednesday May 27th. Book over Memorial Day weekend from Friday to Wednesday and get two days free on your rental!
Policies and Terms
In order to be eligible for our rental services, we need the following from you:
Completely fill out, sign, and return a copy of this rental agreement OR electronically accept these terms during the rental reservation online checkout process.
You must be at least 21 years of age to be able to rent from Rental House by Roberts Camera.
Provide a valid and current Driver's License or equivalent State/government issued ID for proof of identity.
Provide a valid and active credit card to secure your account.
First Time Renters Only:
Roberts reserves the right to request a credit card authorization holding the amount of $1000.00 (or full value of the rental equipment, whichever is less). For first time renters we will limit the total value of the gear allowed to be rented at $3000 unless a valid certificate of insurance is provided.
Credit Card and Government ID Scans:
We will scan a form of government issued ID to have on hand and attach to the customer profile.
If the pickup person is different than the one who placed the order, a copy of their ID will need to be presented at pick-up.
Credit Card information will be stored in our point of sale system in case we need to charge any fees after drop-off or need to charge late fees and more if we can not reach you the day of or after return.
Terms of Rental
Rentals made more than 24 hours in advance can be picked up after 3:00pm the day before the start date of your reservation.
i.e., a reservation for Wednesday can be picked up Tuesday after 3:00pm, or any time Wednesday before 3:00pm.
Rentals must be returned by 10am the day after the last reserved date. Where the Equipment has not been received back by Roberts Camera by the date & time specified by the rental contact, rental charges will continue to accrue at the rates set forth in the rental contract. Failure to return on time will result in extra day charge and other applicable fees.
i.e., a reservation ending on Thursday must be returned by 10:00am on Friday.
Reservations made on the same day as pickup will be prepared as soon as staff are able to.
Weekend rates are for a Friday start date and Monday end date, and pricing for most items is discounted to a rate of 1.5 times the day rate of the item.
Weekend reservations can be picked up as early as Thursday at 3:00pm and must be returned no later than Tuesday at 10:00am.
It is recommended to reserve equipment at least 24 hours prior to the start date/pickup date.
Orders for items under $3,000 MSRP will be able to be reserved online.
Renters who cancel with less than 24 hours notice or do not show up to pick up their rental will not be refunded.
By placing a reservation without providing a valid Certificate of Insurance, the renter agrees to full responsibility for any damages or replacement costs that may occur.
Placing a reservation and/or reading the Policies and Terms page will serve as the damage waiver for all rentals that do not provide a valid certificate of insurance.
Reservations including items that are $3,000 or more will need to be approved by rental house staff, and will require a certificate of insurance for rented equipment coverage.
Certificate of Insurance Requirements:
Rented Equipment or Inland Marine Equipment Floater Insurance required.
General Liability Insurance may be required depending on equipment use case.
No "unattended vehicle" exclusion.
Loss Payee: Roberts Camera or Roberts Distributors, LP.
The mobile equipment coverage is replacement cost and includes transit and world-wide coverage.
If rental staff is not notified of a cancellation by 3:00pm on rental reservation start date, the reservation will be automatically canceled.
Delivery
The Customer, by accepting this Rental Account Agreement, acknowledges that the Equipment will be deemed “delivered” when it leaves Roberts Camera's place of business in the possession of the Customer or any third-party carrier. The Customer bears full responsibility for all selection of and payment to any third-party carrier, and for any other obligations under applicable transportation agreements, unless other arrangements are made in writing and signed by the Customer and an authorized representative of Roberts Camera.
Return
Except as otherwise provided herein, the Equipment shall be deemed "returned" to Roberts Camera when it has been returned to and received by Roberts Camera at Roberts Camera's place of business (815 N. Delaware Street, Indianapolis, IN 46204), and verified by Roberts Camera employees as undamaged and in working condition. The Customer shall continue to bear any and all risks of loss and/or damage to the Equipment until return has been accomplished in this manner. Equipment that has been damaged or destroyed while in the possession of the Customer, an agent of the Customer or any third-party carrier, shall not be deemed to have been “returned” to Roberts Camera until such time as it has been repaired and the Customer has been released in writing by an authorized representative of Roberts Camera from liability for any future rent, or Roberts Camera has received full replacement value from the Customer or the Customer's insurer. Likewise, Equipment that has been lost, stolen or seized by a governmental agency prior to being returned to and received by Roberts Camera shall not be deemed to have been “returned” until Roberts Camera has received full replacement value from the Customer or the Customer's insurer or the Equipment has been released by the governmental agency or their party and is in the physical custody of authorized Roberts Camera employees in an undamaged condition.
If you encounter any issues with the equipment you rented, please call us immediately at 317-814-0100. If the issue occurs outside of business hours, we ask that you document it so that we can review it upon return and help resolve/amend the scenario.
Roberts Camera warrants that, when delivered to the Customer, all Equipment will be operational to accepted manufacturer's specifications. In the event of malfunction, Customer must notify Roberts Camera immediately. Roberts Camera will have no responsibility for any malfunction reported after termination of the rental for such Equipment. Customer shall not attempt to service or repair any of the Equipment and any attempt by the customer to service or repair Equipment will void the limited warranty provided herein. Except as set forth herein, Roberts Camera makes no warranty with respect to the Equipment. Roberts Camera expressly disclaims any warranty, implied or suffered by the Customer or any third party. Roberts' liability for any breach of the warranty granted hereunder shall be, in Roberts Camera's discretion, limited to replacement or repair of any malfunctioning Equipment or a refund of any rent paid by the Customer in connection with such Equipment.
Use of Equipment
The Customer shall at all times retain the Equipment in its own custody. The Customer shall operate the Equipment in accordance with the manufacturer's instructions and contemplated use and shall not use the Equipment in any manner which will subject it to abnormal or hazardous conditions, including, but not limited to: not using the Equipment in accordance with manufacturer's instructions and contemplated use, negligence (defined as, but not limited to, failure to provide prudent security measures to prevent theft or carelessness in maintaining the Equipment properly); or misuse (defined as, but not limited to, improper use of the Equipment causing damage due to the utilization of the Equipment in a manner for which it is not designed). The Customer shall not make any alterations or improvements to the Equipment without the prior written consent of Roberts Camera and shall not deface, remove, or cover any nameplate on the Equipment showing Roberts Camera ownership. All Equipment shall be operated in accordance with applicable Federal, State and local laws.
Additional Fees
Cleaning Fee:
For gear that comes back in offensively dirty condition, the renter may be charged up to 25% of the rental fee as a cleaning fee, or $20 per item—whichever our cleaning team deems appropriate.
This does not include the $25 sensor cleaning fee that may be charged if the sensor is dirty.
Any equipment that comes back with offensive odors (i.e. animal, smoke, etc.) or with a dirty exterior will be subject to a $20 cleaning fee per item.
Lens Cap Fee:
We will charge $5 per cap fee for any missing lens/body/rear cap if missing when returned.
Sensor Cleaning Fee:
We will charge $25 per sensor that is returned needing cleaning.
We ask that you do not try to clean the sensor yourself as it could damage the sensor.
Immediate Card Format:
Any cards that are rented out will be formatted immediately upon return. We ask that you make sure all footage has been properly transferred off of any rented media before return.
Additional Rental Terms
If you leave before gear has been completely checked for damage/imperfections/etc., or without paying a late fee, the credit card on file will be automatically charged.
All equipment that is taken out for rental will be billed on the invoice. If there are any issues with rented equipment, you will be asked to provide photo or video documentation to demonstrate the error so that our staff can properly diagnose and resolve the issue.
If you fail to return equipment as scheduled or communicate with our team, Rental House by Roberts Camera will consider equipment stolen and will make all efforts to recover. Any and all costs to effect recovery will be the responsibility of you, the renter.
This Rental Account Agreement, and any Rental Agreement, constitutes a lease and not a sale of the Equipment or the creation of a security interest therein. No part of the rental payments made under this Agreement shall be deemed payment towards the purchase of any of the Equipment. Title to the Equipment shall remain at all times in Roberts Camera. The Customer hereby acknowledges Roberts Camera's ownership and title in the Equipment and agrees to keep the Equipment free of all liens, levies, and encumbrances. This Agreement constitutes a lease to the Customer exclusively and the Customer shall not assign any rights under this Agreement, or sublease the Equipment to any other person or entity without consent by Roberts Camera.
Governing Law
This Rental Agreement shall be governed by and construed in accordance with the laws of the State of Indiana. Venue in any action involving the Equipment, this Rental Account Agreement, or any Rental Agreement, shall be in courts having situs in Marion County, Indiana. The prevailing party in any proceeding shall be entitled to an award of reasonable attorneys' fees and litigation costs.
Invoices and Receipts
Terms and conditions set forth in any Rental Contract, Invoice, or Receipt issued by Roberts Camera pursuant to a Rental Agreement shall be deemed part of the Rental Agreement.
Indemnification
The Customer hereby agrees to indemnify and hold Roberts Camera harmless from and against any and all losses and/or claims, including without limitation reasonable attorneys' fees, arising out of Customer's possession, use or operation of the Equipment during the time between delivery of the Equipment to the Customer and its return to Roberts Camera.
Miscellaneous
This Rental Account Agreement, the Rental Agreement, the online reservation confirmation and any written amendments thereto, shall constitute the entire Agreement of Roberts Camera and the Customer with respect to the Equipment. This Agreement may not be modified except in writing signed by both the Customer and an authorized representative of Roberts Camera. The Customer hereby represents to the best of its knowledge, that all information provided in the Rental Account Agreement and any Rental Agreement is true and correct. By signing this Rental Account Agreement and accepting delivery of Equipment from Roberts Camera, the Customer agrees to be bound by all of the Rental Terms and Conditions in effect from time to time, as set forth herein.
